You must be at least eighteen (18) years of age and hold the legal capacity to enter into binding contractual agreements to utilize our services. If you do not agree to these Terms in their entirety, you must immediately cease all access and use of our platform.

HOAFINECHECK.COM IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE, OPINIONS, OR LEGAL REPRESENTATION.

Our website, automated document wizards, statutory calculators, and templates are self-help informational tools designed solely to assist individual homeowners in drafting correspondence and understanding publicly accessible statutes governing common interest developments.

No attorney-client relationship is created or intended to be created between you and HOAFineCheck.com, its operators, employees, or affiliates through your use of the service. Communications between you and HOAFineCheck.com are protected by our Privacy Policy but are NOT protected by attorney-client privilege or work-product doctrines.

3. User Responsibilities & Representations

By using our service, you agree and warrant that:

• All information, dates, monetary values, and factual accounts you input into our document wizards are accurate, complete, and truthful;
• You will review, verify, and edit all generated correspondence before signing, mailing, or serving it upon any third party;
• You understand that association rules and municipal laws vary widely by county, city, and recorded master deed, and that you remain solely responsible for verifying local legal applicability;
• You will not use the generated documents for unlawful harassment, fraudulent misrepresentation, or extortionate purposes.

4. Purchases, Subscriptions & Refund Policy

Certain features, automated document generation kits, and audit modules require payment of one-time or subscription fees as detailed on our Pricing page. All fees are stated in U.S. Dollars.

14-Day Satisfaction Guarantee: If our generated dispute documentation fails to comply with your state's statutory format or you are dissatisfied with our self-help tool, you may request a full refund within fourteen (14) calendar days of purchase by contacting our support team at gerry@hoafinecheck.com. Refunds are processed back to the original Stripe payment method.

5. Intellectual Property Rights & Limited License

The design, software code, UI components, proprietary prompts, statutory knowledge bases, algorithms, logos, and written content on HOAFineCheck.com are the exclusive intellectual property of the Company.

Upon purchase, Company grants you a non-exclusive, non-transferable, revocable, limited license to download, print, edit, and transmit the generated documents solely for your personal, non-commercial use in disputing specific association matters involving your residential property. Reselling, redistributing, or incorporating our templates into commercial software or legal services without written consent is strictly prohibited.

6. Disclaimer of Warranties

THE SERVICE, TOOLS, AND GENERATED MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OUTCOME GUARANTEES.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE GUARANTEE THAT ANY HOA BOARD, PROPERTY MANAGER, OR COURT WILL RULE IN YOUR FAVOR OR RESCIND ANY FINE.

7. Limitation of Liability & Dollar Cap

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOAFINECHECK.COM, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROPERTY, ASSESSMENT LIENS, FORECLOSURE PROCEEDINGS, EMOTIONAL DISTRESS, OR THIRD-PARTY LEGAL FEES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, UNDER ANY LEGAL THEORY (WHETHER CONTRACT, TORT, NEGLIGENCE, OR STRICT LIABILITY), SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO HOAFINECHECK.COM IN THE PRECEDING SIX (6) MONTHS, OR (B) FORTY-NINE DOLLARS AND NINETY-NINE CENTS ($49.99 USD).

8. Indemnification

You agree to defend, indemnify, and hold harmless HOAFineCheck.com, its officers, directors, contractors, and agents against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) resulting from: (a) your breach of these Terms; (b) any false, misleading, or fraudulent information provided by you; or (c) your violation of any third-party rights or laws.

9. Third-Party Integrations & Payment Processors

We utilize third-party vendors including Stripe, Inc. for payment processing and cloud hosting providers. We do not store complete credit card numbers. Your payment transactions are subject to Stripe's Terms of Service and Privacy Policy.

10. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to your use of HOAFineCheck.com shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11. Mandatory Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY: Any dispute, claim, or controversy arising out of or relating to these Terms, their breach, or your use of HOAFineCheck.com shall be settled by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

CLASS ACTION WAIVER: YOU AND HOAFINECHECK.COM AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
